TERMS OF SERVICES AGREEMENT

Acceptance of Terms
The Double Fifth Dragon Boating and/or the USA Dragon Boating, LLC website, (the "Website") and all of its content and services is owned and/or operated by USA Dragon Boating, LLC and its designated agents or service providers. Your use of this Website is conditioned upon your acceptance without modification of the terms, conditions, and notices contained or referenced in this Terms of Service Agreement (the "Agreement"). Look, we hate this stuff as much as you, but we paid a lot of money to our lawyers and they said we gotta do it.


Order Acceptance Policy
Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. USA Dragon Boating, LLC and or Double Fifth Dragon Boating reserves the right at any time after receipt of your order to accept or decline your order for any reason. USA Dragon Boating, LLC and or Double Fifth Dragon Boating reserves the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item. We may require additional verifications or information before accepting any order. Look, don't get us wrong. We WANT to sell you stuff, but this is being done on a computer and we all know what THAT means. If we really are unsure if you are ordering or just clicking on stuff randomly we'll get in touch with you. If it's for the random stuff, we'll send over Guido.

International Shipping Policy
USA Dragon Boating, LLC and or Double Fifth Dragon Boating can accept orders from and ship to Canada and certain other countries world wide. The amount charged for shipping in the shopping cart is an estimate only and may be significantly different than the actual charges. We will contact you with the correct shipping charges if they are different.

International shipping rates apply to all orders shipped outside the Continental U.S., Alaska, and Hawaii. Free shipping offers do not apply to international orders. Actual shipping charges will be calculated at the time of order. Our shiping rates are based on Fedex and United States Postal Service rates and we typically ship via Fedex and the United States Postal Service. We reserve the right to substitiute or change shipping companies with no notice. Not all international shipments are trackable.

You may be subject to brokerage fees, import tariffs, customs duties, customs clearance fees and value added taxes, as well as other local taxes assessed by customs authorities at the time of delivery to the destination country. These additional charges, generally known as Import Fees for customs clearance, are borne by you; we have no control over these Import Fees and do not calculate them at the time of purchase. Our international shipping rates reflect the base shipping charge not including Import Fees. Customs policies vary widely from country to country; you should contact your local customs office for further information. Additionally, when ordering from USA Dragon Boating, LLC and or Double Fifth Dragon Boating, you are considered the importer of record and must comply with all laws and regulations of the country in which you are receiving the goods. If you refuse to pay your local duty or tax and the carrier bills USA Dragon Boating, LLC and or Double Fifth Dragon Boating for the unpaid charges, these charges will be deducted from any refund for the rejected product. Failure to pay customs Import Fees may also jeopardize or terminate your ability to place future orders.

Your privacy is important to us, and we know that you care about how information about your order is used and shared. We would like our international customers to be aware that cross-border shipments are subject to opening and inspection by customs authorities. Also, we may provide certain order, shipment, and product information, such as titles, to our international carriers, and such information may be communicated by the carriers to customs authorities in order to facilitate customs clearance and comply with local laws.

Estimated delivery time is a calculation of time to ship + time in transit to customs + time in customs + time in transit for delivery. USA Dragon Boating, LLC and or Double Fifth Dragon Boating will not be held responsible or liable for any delays or problems that result at your local customs office.

Return shipping costs on international orders are the responsibility of the purchaser on all returned orders. Refunds will be for the merchandise amount only. USA Dragon Boating, LLC and or Double Fifth Dragon Boating cannot refund any duties, taxes or fees paid to customs on the order. No refunds will be given for items that are seized at your local customs office.

To inquire about international orders, please Contact Us. Whew, that was a long one. Bottom line, it's really freakin' expensive to ship internationally so find a bunch of your friends and teammates and send us one big order and we can probably ship it cheaper. Don't even think about trying to rip us off internationally. We have programmer friends in Eastern Europe and we'll send them your IP address. Guido ain't nothing compared to an Eastern European hacker on a mission.

Typographical Errors
In the event content on the Website contains incorrect information, or a product is listed at an incorrect price, due to typographical errors or error in pricing information, USA Dragon Boating, LLC and or Double Fifth Dragon Boating shall have the right to refuse or cancel any orders placed for products listed at the incorrect price. USA Dragon Boating, LLC and or Double Fifth Dragon Boating shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, USA Dragon Boating, LLC and or Double Fifth Dragon Boating shall immediately issue a credit to your credit card account in the amount of the incorrect price. We have this section because sometimes we are idiots with fat fingers who can't type and forget how to proof a document. As we grow larger we will blame this on an intern.

Unsolicited Ideas
USA Dragon Boating, LLC and or Double Fifth Dragon Boating welcomes feedback, questions and comments about its products, services and this Website. As a general policy, USA Dragon Boating, LLC and or Double Fifth Dragon Boating does not accept unsolicited ideas for products or services through this Website. All communications and other materials (including, without limitation, unsolicited ideas, photographs, drawings, suggestions, or materials) you send to this Website by e-mail or otherwise are and shall remain the sole and exclusive property of USA Dragon Boating, LLC and may be used by us for any purpose whatsoever, commercial or otherwise, without compensation to you. OK, we'll try to at least give you some credit, but don't count on it. Trust me, we have plenty of ideas already, in fact our heads are about to explode we have so many. In the event that USA Dragon Boating, LLC and or Double Fifth Dragon Boating learns it has collected any personal information from a child under the age of 13 without verification of parental consent, USA Dragon Boating, LLC and or Double Fifth Dragon Boating will delete that information from its database as quickly as reasonably possible. Indemnification

Jurisdiction
The services and information on this site are available in the United States and may not be available elsewhere. This Agreement shall be construed in accordance with the Laws of the United States of America, specifically the state of New Hampshire. All disputes arising from your use of this Website or under this Agreement shall be resolved in a court located in New Hampshire, without reference to conflict of laws or choice of laws statutes. We reserve the right to take any disputes to Judge Judy or any of the other TV courts. That should settle any disputes quickly.

Governing Language
Any translation of this Policy is done for local requirements and in the event of a dispute between the English and any non-English versions, the English version of this License Agreement shall govern.
